The General Terms and Conditions as described here apply to every product offered on the FURNIFIED webshop and all deliveries. Every order implies acceptance of the terms and conditions of sale. The consumer has the right to inform the seller that he renounces the purchase, without paying a fine and without giving any reason within 14 calendar days from the day following the delivery of the product or the conclusion of the service agreement. The General Terms and Conditions are exclusively governed by Belgian law.

Definition

  • Working days are the whole of all calendar days excluding Saturdays, Sundays and legal holidays.

Purchase and payment

  • To order in this webshop, the buyer must be at least 18 years old.
  • The agreement between FURNIFIED and you as a buyer is concluded when you have accepted and fulfilled the conditions set by FURNIFIED. The absence of an ordinary signature does not affect the binding force of the offer and its acceptance.
  • FURNIFIED reserves the right to refuse an order or to subject it to additional conditions, such as large orders, orders by minors, incomplete order procedures or problems with previous orders.
  • FURNIFIED always confirms the purchase by e-mail. If no confirmation email has been sent yet, the agreement is not yet in force.
  • Payment of products purchased from FURNIFIED is made exclusively by proposed means of payment.
  • The seller remains the owner of all goods until full payment has been made.
  • To guarantee a secure online payment and the safety of your personal data, the transaction data is sent encrypted with SSL technology over the internet. You do not need any special software to pay with SSL.
  • Furnified's invoices are payable at its registered office and at the latest on the due date. In the absence of timely payment, the invoice will be increased by operation of law and without notice of default with a default interest of 10% and a fixed compensation equal to 10% of the invoice amount, with a minimum of EUR 100.00.
    • If an invoice is not paid on its due date, all other sums due, even if they have not yet fallen due, become immediately due and payable.
    • In case a delivery only takes place in part, the corresponding price is due. When paying, the client may under no circumstances withhold an amount as security. Such a deduction is considered a late payment.
    • Furnified may suspend its deliveries if the client fails to meet its payment obligation. Complaints do not lead to the payment obligations of the client being suspended.
  • The General Terms and Conditions and the confirmation emails are always drawn up in the language of the website.

Delivery and delivery times

  • The delivery times specified by FURNIFIED are approximate and are not strict deadlines.
  • If you order a product that is temporarily out of stock, it will be indicated when the product will be available again.
  • As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products is transferred to the buyer.
  • Different conditions may apply for deliveries abroad.
  • FURNIFIED delivers in the following countries: Belgium and the Netherlands. Other countries on request.
  • Delivery takes place exclusively by courier service unless otherwise agreed prior to the agreement.
  • Orders are shipped when all ordered goods are available. This complete delivery is included in the delivery costs stated on the website. Part deliveries are possible subject to payment of an additional cost (= delivery cost stated on the website). Any delay of a single product will cause a delay of the entire delivery.
  • The delivery or shipping costs will be communicated to you before confirming your purchase. If the shipping costs cannot be calculated automatically, this will be stated and/or an indication of the shipping costs will be provided.
  • In the case of custom-made products, products that are produced at the request of the customer or products that are adapted to the wishes of the customer, a change in delivery term does not under any circumstances give the right to cancel the order. If a custom product, product produced at the request of the customer or a product adapted to the customer's wishes is cancelled, FURNIFIED has the right to retain 50% of the amount paid to cover the costs incurred.

Cancel order before delivery.

  • The consumer can cancel his order free of charge at any time, with the exception of the following cases:
  • (1)- The order is already 'in delivery'. 'In delivery means: already forwarded to the warehouse, courier service or transport partner.
  • (2)- The order contains customized products, products that are produced at the request of the customer or products that are adapted to the wishes of the customer.
  • (3)- The order was placed by professionals. Customers who purchase with a VAT number fall under B2B law and not under consumer law.
  • (4)- The order contains items that are on promotion or that are part of a promotional campaign.
  • (5)- The order was placed in 1 of our showrooms or temporary stores.
  • If products mentioned in the above list are cancelled, FURNIFIED reserves the right to retain 50% (1)(2)(3) or 20% (4)(5) of the amount paid to cover the costs incurred .

Product information

  • Information, images, verbal announcements, statements, etc. with regard to all offers and the most important characteristics of the products that are provided by telephone or e-mail are given or made as accurately as possible. FURNIFIED is not liable for advice it provides, printing and typesetting errors on the website or technical data provided by suppliers or producers.
  • Availability is indicated for each product. FURNIFIED makes every effort to communicate this information correctly, but it may happen that there is an impossibility to deliver. This can be due to inadvertently incorrect stock data or products that are no longer available from the suppliers. In these cases, FURNIFIED will notify you as soon as possible and propose a solution. For customized products or products adapted to your wishes, a change in delivery period does not under any circumstances entitle you to cancel the order. If a custom product or a product adapted to your wishes is cancelled, FURNIFIED has the right to withhold 50% of the amount paid to cover the costs incurred.
  • The products offered by FURNIFIED comply with legal standards and may be sold online.
  • It is possible that FURNIFIED includes links on its website to other websites that may be of interest or information to the visitor. Such links are for informational purposes only. FURNIFIED is not responsible for the content of the website referred to or the use thereof.
  • The information listed under the 'frequently asked questions' on our website forms part of the general terms and conditions.

Reflection period (trial period) and returns

  • For all products purchased from FURNIFIED, according to the Belgian law on commercial practices, consumer information and protection of April 12, 2010, you have a cooling-off period of 14 calendar days.
  • This period starts at the moment of receipt by you or on your behalf. During the cooling-off period, we expect you to handle the goods and the packaging with care. There is no right of renunciation if the product and packaging are no longer in their original, complete, undamaged and unused condition.
  • If you wish to make use of the right of renunciation, you must make this known in writing or by telephone within the stipulated 14 calendar days from the day following the delivery of the product. There is no payment of a fine associated with the cancellation of the purchase and this can be done without stating the reasons. More information about canceling or returning your order can be found in the cancellation, return and exchange section on our website.
  • You must return the goods undamaged, unused and unopened (in original condition and packaging) within 14 days of receipt at the latest. The shipping date serves as a check. All accompanying documentation, warranty certificates and packaging materials must be included with the return shipment, as well as your bank account number. The direct costs for returns are the responsibility of the buyer. Unstamped or insufficiently stamped shipments are always refused and returned to the sender.
  • FURNIFIED will refund the full purchase price (excluding transport costs) within 30 days of receipt of the goods.
  • If it appears that the goods have not been received in accordance with the conditions of the right of renunciation, the purchase price including the shipping costs will not be refunded or not fully refunded. In that case, the product remains your property. At your request, the product can also be sent to you again, subject to payment of the associated shipping costs.
    • Exceptions to the stipulations are as follows: (2)- The order contains customized products, products that are produced at the request of the customer or products that are adapted to the wishes of the customer. (3)- The order was placed by professionals. Customers who purchase with a VAT number fall under B2B law and not under consumer law. (4)- The order contains items that are on promotion or that are part of a promotional campaign. (5)- The order contains items purchased in 1 of our showrooms or temporary stores. (6)- The order contains a product that has been visibly used or otherwise damaged. If products mentioned in the above list are returned, FURNIFIED reserves the right to retain 100%(6), 50%(2)(3) or 20%(4)(5)(6) of the amount paid to cover the costs incurred.
    • Goods must be returned to the following address: Merantistraat, Building S9, 2030 Antwerp, Belgium
    • If you opted for collection, the return or exchange must be made in the same way, i.e. in the branch where the collection was made.
    • The exchange or return of non-conforming or defective products or parts can only take place at delivery addresses in BE or NL

Warranty conditions

  • FURNIFIED follows the official 2-year warranty guidelines. Settlement of warranty will be borne by FURNIFIED except for the shipping costs incurred by the consumer to return the product to us.
    • Breakages or injuries in marble/terrazo or other porous materials are covered by warranty up to 7 days after delivery. Unfortunately, we cannot offer a guarantee on breakages/injuries later than 7 days after delivery.
    • Marble/terrazo is a type of stone that requires careful aftercare; It is best to purchase a treatment product for this. you can ask for advice at the nearest specialist shop or send us an email for more information about after-treatment. Stains or circles caused by not carefully following the stone are the responsibility of the user and are not covered by the warranty.

Defects

  • You must carefully inspect the goods immediately upon receipt. You must check whether the delivered goods comply with the agreement:
    • Were the correct goods delivered?
    • Do the delivered goods meet the agreed quality requirements or - if these are lacking - the requirements that may be set for normal use?
  • If a visible defect or shortcoming is found, you must report this to FURNIFIED within 7 working days after delivery.
  • The costs for returning goods that do not comply with the description of the offer are at the expense of FURNIFIED.

Force majeur

  • Force majeure includes all external causes, foreseen or unforeseen, on which FURNIFIED cannot exert any influence, but as a result of which FURNIFIED is unable to fulfill its obligations.
  • FURNIFIED also has the right to invoke force majeure if the circumstance that prevents (further) fulfillment occurs after FURNIFIED should have fulfilled its obligation.
  • During force majeure, the delivery and other obligations of FURNIFIED are suspended. If the period in which fulfillment of the obligations by FURNIFIED is not possible due to force majeure lasts longer than 16 weeks, both parties are authorized to dissolve the agreement, without any obligation to pay compensation in that case.

Prices

  • You will be informed of the prices of the goods before checkout. All prices are expressed in euros and include VAT, Recupel, BEBAT and Reprobel. The shipping costs are stated separately.
  • If FURNIFIED agrees a certain price with you, FURNIFIED is nevertheless entitled to increase the price.
  • Offers are valid while stocks last.
  • If a price increase takes place after the conclusion of the agreement and the price in the agreement is adjusted accordingly, you can dissolve the agreement regardless of the percentage of the increase.
  • A personalized offer is valid for 2 weeks, unless a different period is stated in the offer.

Intellectual property rights

  • The contents of this site, including brands, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to FURNIFIED or entitled third parties.

Questions and complaints

  • Complaints or disputes must be reported within 14 days after delivery. If the complaint is found to be justified, our liability is limited to the exchange of the goods. Any liability of the seller is limited to the amount actually paid for the order.
  • FURNIFIED always handles questions and complaints within a reasonable period of 14 calendar days.

Disputes

  • All offers and agreements are exclusively governed by Belgian law, to the exclusion of the principles of conflicts of law in space.
  • All disputes related to or arising from offers from FURNIFIED, or agreements concluded with it, will be submitted to the competent court in Antwerp, unless a mandatory legal provision expressly designates another court as competent.

Promotional Actions (via social media or the website)

  • Participation is always possible until the end of the month, unless stated otherwise.
  • Winner will be informed personally and not via social media or the website, in order not to compromise the privacy of the winner.
  • The winner will always be personally informed of the result of the promotion the week after the end of the promotion. Furnified does not undertake to inform all participants of the result of the promotion.
  • Furnified employees are excluded from the promotions.
  • All disputes related to or arising from offers from FURNIFIED, or agreements concluded with it, will be submitted to the competent court in Antwerp, unless a mandatory legal provision expressly designates another court as competent.

Limitation of Liability

  • The information on the website is of a general nature. The information is not adapted to personal or specific circumstances and can therefore not be considered as personal, professional or legal advice to the user.
